term as governor. everyone expected him to win this race. that is what it is going to happen at this moment with 8% of the precinct reporting. he has 55 percent of the wrote vote. main republican rival are the these people brown spoke few minutes ago. >> i campaigned hard. i take nothing for granted. and i just have to say that california has come a long way in the last few years. >> if so governor brown expected to win reelection. let's move to the lieutenant governor race incumbent former san francisco mayor newsom running for reelection as wechlt he appears to be on his way to the november run off. he has 50% of the vote. ron has 23 percent and david fenn has anyone percent of the vote. incumbent newsom with half the vote tonight as we expected from the polling. one of the biggest bay area race san jose mayor. there are 8 names on

the ballot. the top 2 will advance to likely november run off to replace term out mayor reid. at this moment cortez has 34 percent of the vote. riccardo has 25% of the vote. only 2% of the precinct are reporting so still very early on. but again the top 2 vote getters will advance to the run off election in november. madison has 23 percent of the vote. now taking a look in south bay as well to the representative race. mike honda facing serious and well funded challenge from fellow democrat row kop you have seen the ad for him on television advertised very heavily. very well financed campaign. for primary race. incumbent mike has 51 percent of the vote. row has 26 pevrments zing has 16 percent drilling in the distance. all right another race that we are watching very closely. state senate race between east bay assemblyman

candidate endorsed by the club. the city council has been struggling for years to come up with laws. regulating the operation and locations of the pot clubs. club owner david hodge says his club will live or die by those laws. >> if the council proves what they are currently talking about it would be an effective ban shutting down most the dmrex san jose what they do on election day may illegal. we asked registrar about that. >> we have lacked at the california election code. it doesn't seem to be in violation of that. but looking at federal code it does appear there may be a violation. >> mayor reid did not mince his words when he answered. >> it's against the law but then again we have an industry that operates in violation of federal law every minute of every day. >> group called sensible hand so say collected enough signature to place their own referendum in the november election. 38,000 signatures to be exact. they say they will turn them in tomorrow. if

there is a referendum mayor reid says he will lead the campaign against it. vic lee 7 news. >> controversial policy requiring pregnancy test for most women booked into alameda county jail is the subject of a lawsuit by the aclu. the age limit now 60 but one of the plaintiffs in the lawsuit given the test in 2010 when she was nearly 70. 7 news reporter laura anthony has the story. >> oakland susan says she was among 78 protestors arrested 4 years ago and booked in the alameda county jail downtown. after demonstrations that came in the wake of the messerly vivrmentd i said this is silly. >>reporter: despite her age 69 at the time like all the women in the group harmon ordered to take a pregnancy test. >> 3 of us were taken in to the large bathroom by female sheriff officer and asked to

pee in the cup. >>reporter: harmon says she was never told the reason for the pregnancy test or the result. now harmon is one of 3 plaintiffs in the lawsuit filed by the american civil liberties union against the alameda county sheriff's department. >> unfortunately you know they are the only county that we know of in california that has this policy. >>reporter: elizabeth is the aclu attorney who filed the lawsuit. suit claims mandatory pregnancy testing at any age by a jail is a violation of civil rights. and illegal. >> unconstitutional. violent women right to privacy and it's also unconstitutional search and seizure t.and it violates a very clear california law. folk in custody are required to give in formed consent. >> very personal thing about being pregnant or not and if sheriff's officer isn't the person that the first person that i want to know whether of i was pregnant or not.

fight good evening once again. we begin this half hour updating top races in today primary election. poll closed now for exactly an hour and a half. governor brown going for unprecedented fourth term the 55 percent of the vote which men's in the november one off against second place finisher. top 2 go to that run off even if one has more than 50%. so at this moment neal has 18 percent of the vote. tim donnelly has 15 percent of the vote in the governor race. moving on to the race for san jose mayor. top 2 advancing to the a lickly november run off to replace term out mayor reid. dave has 34 percent of the vote. sam 25%. madison winn has 23 percent. top 2 go on to the november election. >> couple proposition on the ballot to talkbout. prop 41
